Terms of Service

These Terms of Service govern your use of the GenTech Generator Services website and any quote requests, service requests, rentals, repairs, maintenance, installations, generator sales, temporary power services, or other services provided by GenTech Generator Services (“GenTech,” “we,” “us,” or “our”).

GenTech may provide services to customers in The Commonwealth of The Bahamas and the United States of America.

By using this website, submitting an inquiry, requesting a quotation, accepting a quotation, scheduling service, renting equipment, purchasing equipment, or otherwise engaging GenTech, you agree to these Terms.

1.Services

GenTech may provide services including:

  • Generator sales
  • Generator rentals
  • Generator repairs and diagnostics
  • Preventative maintenance
  • Generator installation
  • Generator replacement or removal
  • Automatic transfer switch services
  • Temporary power solutions
  • Residential generator services
  • Commercial generator services
  • Generator sizing assistance
  • Related electrical or mechanical services where permitted
  • Other custom generator and power services

Services offered may vary depending on the customer's location, project requirements, equipment, local regulations, technician availability, parts availability, and other factors.

Submitting a website request does not guarantee that GenTech will accept or perform the requested work.

2.Custom Quotes

GenTech primarily operates on a custom-quote basis.

Customers may be asked to provide:

  • Full name
  • Phone number
  • Email address
  • Service address or location
  • Residential or commercial property information
  • Generator brand and model
  • Generator size or kW rating
  • Fuel type
  • Description of requested work
  • Equipment or property photographs
  • Rental dates
  • Project requirements
  • Other relevant information

A website submission is only a request for information, service, or pricing. It is not a binding contract or confirmed appointment.

A service becomes confirmed only after GenTech accepts the request and any required quotation, work authorization, rental agreement, deposit, payment, or other required documentation has been completed.

3.Quotes and Estimates

Quotes are based on the information available to GenTech at the time they are prepared.

Pricing may change if:

  • Customer information is inaccurate or incomplete
  • Additional faults are discovered
  • Site conditions differ from what was originally described
  • Additional labor is required
  • Additional materials or parts are needed
  • Equipment specifications differ
  • The scope of work changes
  • Transportation or travel requirements change
  • Supplier pricing changes
  • Permits, inspections, or regulatory requirements create additional work

Where practical, GenTech will notify the customer before performing material additional work that results in additional charges.

4.Customer Responsibilities

Customers are responsible for providing accurate information and disclosing known conditions that could affect the work. This may include:

  • Existing electrical problems
  • Fuel leaks
  • Previous repairs
  • Equipment modifications
  • Water damage
  • Flooding
  • Structural problems
  • Unsafe conditions
  • Restricted access
  • Hazardous materials
  • Existing code violations where known

Customers must provide reasonable and safe access to the equipment and work area.

GenTech may refuse, postpone, or discontinue work if conditions are unsafe or unlawful.

5.Repairs and Diagnostics

Diagnostic services are intended to help identify generator faults but do not guarantee that equipment can be repaired.

Additional faults may become apparent after initial repairs are completed. Repairability may depend on:

  • Equipment condition
  • Age
  • Previous maintenance
  • Previous repairs
  • Parts availability
  • Manufacturer support
  • Damage severity

If additional work is required, GenTech may provide an updated recommendation or quotation.

6.Preventative Maintenance

Preventative maintenance can help improve generator reliability but cannot guarantee that equipment will never malfunction or fail.

Customers remain responsible for following appropriate maintenance schedules, operating instructions, fuel requirements, and manufacturer recommendations.

7.Generator Sales

Generator recommendations may be based on information supplied by the customer and, where applicable, a site assessment.

Customers must provide accurate information about what they intend to power.

GenTech does not guarantee equipment availability until an order or reservation has been confirmed.

Manufacturer specifications, pricing, availability, delivery dates, and warranty coverage may change without notice.

Manufacturer warranties remain subject to the manufacturer's own terms.

8.Generator Rentals

Rental equipment remains the property of GenTech or the applicable equipment owner.

Rental customers are responsible for using equipment safely and only for its intended purpose.

Customers may be responsible for costs associated with:

  • Rental periods
  • Late returns
  • Delivery
  • Pickup
  • Setup
  • Fuel
  • Cleaning
  • Lost equipment
  • Theft
  • Misuse
  • Unauthorized modifications
  • Excessive damage beyond ordinary wear

A separate rental agreement may contain additional terms.

If a separate rental agreement conflicts with these general website Terms, the specific rental agreement will control for that rental transaction.

9.Installation Services

Generator installations may depend on:

  • Local building codes
  • Electrical codes
  • Fuel-system requirements
  • Permit requirements
  • Inspection requirements
  • Utility requirements
  • Property conditions
  • Manufacturer specifications

GenTech will perform only work it is legally permitted and properly authorized to perform in the jurisdiction where the work takes place.

Additional work caused by site conditions or regulatory requirements may result in additional charges.

10.Licenses, Permits and Code Compliance

Certain services may legally require licensed electricians, contractors, gas professionals, permits, inspections, or other qualified professionals.

Requirements differ between U.S. states, counties, municipalities, territories, and Bahamian jurisdictions.

GenTech will not represent itself as holding a license, certification, dealer authorization, or professional qualification unless that credential is currently valid and applicable to the work being performed.

Where another licensed professional is required, that portion of the work may need to be performed or approved by an appropriately qualified party.

11.Deposits and Payments

Certain purchases, rentals, and projects may require a deposit or advance payment, including:

  • Generator purchases
  • Rentals
  • Repairs
  • Installations
  • Parts orders
  • Special orders
  • Commercial projects

Applicable payment requirements will be communicated before the transaction is confirmed.

Customers are responsible for paying invoices according to the payment terms shown on the relevant quotation, invoice, rental agreement, or service agreement.

12.Cancellations and Rescheduling

Customers should contact GenTech as early as possible if they need to cancel or reschedule.

Certain costs may be non-refundable, including:

  • Special-order equipment
  • Special-order parts
  • Supplier charges
  • Transportation costs
  • Reserved rental equipment
  • Non-refundable manufacturer charges
  • Work already performed

Any specific cancellation policy provided in a quotation, invoice, rental agreement, or service contract will apply to that transaction.

13.Warranties

Warranty coverage varies depending on the service or equipment involved. A warranty may come from:

  • The equipment manufacturer
  • A parts manufacturer or supplier
  • GenTech, where expressly stated in writing

GenTech does not promise a specific warranty unless it is identified in writing for the applicable service or transaction.

Warranty coverage may be limited or excluded for damage resulting from:

  • Misuse
  • Neglect
  • Improper operation
  • Failure to maintain equipment
  • Unauthorized modifications
  • Unauthorized repairs
  • Contaminated fuel
  • Flooding
  • Fire
  • Lightning
  • Power surges
  • Accidents
  • Natural disasters
  • Conditions outside GenTech's reasonable control

Nothing in these Terms eliminates any warranty or consumer right that cannot legally be waived under applicable law.

14.No Guarantee of Continuous Power

Generators are mechanical and electrical systems and may experience unexpected failure.

GenTech does not guarantee uninterrupted power merely because equipment has been sold, installed, repaired, rented, inspected, or maintained.

Customers with mission-critical power needs should consider appropriate redundancy, maintenance, fuel planning, monitoring, and backup systems.

15.Limitation of Liability

To the fullest extent permitted by applicable law, GenTech will not be responsible for indirect, incidental, special, exemplary, or consequential damages arising from matters such as:

  • Utility outages
  • Generator failure
  • Business interruption
  • Lost revenue
  • Lost profits
  • Spoiled products
  • Lost data
  • Missed events
  • Delayed projects
  • Third-party failures

This limitation applies only to the extent legally permitted.

Nothing in these Terms excludes or limits liability that cannot legally be excluded under applicable consumer-protection or other applicable law.

16.Emergency and After-Hours Requests

Submitting a form through the GenTech website does not guarantee:

  • Immediate response
  • Emergency dispatch
  • 24-hour availability
  • Same-day service

Unless GenTech expressly confirms otherwise, customers should not rely on website forms for life-safety emergencies.

For any immediate danger involving fire, electrocution, fuel leaks, carbon monoxide, or another emergency, contact the appropriate local emergency authority.

17.Customer Photos and Uploads

Customers may submit photographs or documents to help GenTech evaluate a request.

Customers should only upload materials they have the legal right to provide.

Customer-uploaded images related to service requests will not automatically be used publicly for advertising or marketing.

GenTech may retain relevant submissions as reasonably necessary to respond to the customer's request and maintain business records.

18.Website Information

Information on the GenTech website is provided for general informational purposes. Website content does not guarantee:

  • Equipment availability
  • Pricing
  • Service availability
  • Response times
  • Generator suitability
  • Rental availability
  • Manufacturer availability

A professional assessment may be necessary before GenTech can make a final recommendation.

19.Intellectual Property

The GenTech name, logos, branding, website design, written content, graphics, and GenTech-owned photographs are protected intellectual property.

They may not be copied, reproduced, modified, distributed, or used commercially without authorization.

Third-party trademarks and manufacturer names remain the property of their respective owners.

20.Privacy

Personal information submitted through the website may be used to:

  • Respond to inquiries
  • Prepare quotations
  • Contact customers
  • Schedule service
  • Process rentals
  • Provide requested services
  • Maintain business records
  • Improve customer service

Use of personal information is also governed by the GenTech Privacy Policy.

21.Force Majeure

GenTech will not be responsible for delays or failure to perform caused by circumstances reasonably outside its control, including:

22.Refusal or Suspension of Service

GenTech may refuse or discontinue service where reasonably necessary, including situations involving:

  • Dangerous work conditions
  • Threatening or abusive behavior
  • Fraud
  • Non-payment
  • Illegal requests
  • Unauthorized modifications
  • Materially inaccurate customer information
  • Requests beyond GenTech's capabilities
  • Licensing or regulatory restrictions

23.United States Customers

For services performed in the United States, the transaction will be subject to applicable federal law, state law, local law, consumer-protection requirements, licensing requirements, and building and electrical codes.

The specific state and local laws applicable to a service will generally depend on where the work is performed.

Nothing in these Terms is intended to waive any consumer right or legal protection that cannot lawfully be waived.

Where GenTech provides a separate written agreement for a U.S. job, that agreement may specify the applicable state law, dispute venue, licensing information, and other state-specific terms.

24.Bahamas Customers

For services performed in The Commonwealth of The Bahamas, the transaction will be governed by applicable laws and regulations of The Bahamas.

Nothing in these Terms limits rights that cannot legally be waived under Bahamian law.

Where GenTech provides a separate quotation, rental agreement, service agreement, or installation contract, that document may contain additional terms specific to the Bahamian transaction.

25.Governing Law and Jurisdiction

Because GenTech may provide services in more than one jurisdiction:

  • For work performed in The Bahamas: applicable Bahamian law will govern the service transaction unless otherwise required by law.
  • For work performed in the United States: the law of the U.S. state in which the services are principally performed will generally govern the service transaction, unless a separate written agreement lawfully provides otherwise.

Any mandatory consumer-protection, licensing, or other laws applicable to the transaction will continue to apply regardless of these Terms.

26.Separate Agreements

Certain services may require separate written agreements, including:

  • Equipment rentals
  • Generator purchases
  • Installations
  • Commercial projects
  • Maintenance contracts
  • Large repair projects

Those agreements may contain additional terms.

If a specific signed agreement conflicts with these website Terms, the specific agreement will control for that transaction unless applicable law requires otherwise.

27.Changes to These Terms

GenTech may update these Terms periodically.

The most recent version will be posted on the website together with its effective date.
